Fair Treatment and Insurance Bad Faith

In the state of California, the accepted position is that an insurance company is compelled to treat their insured policy holders fairly and in good faith after a claim has been presented. All insurance policies include an implied obligation of good faith and fair dealing which suggests that neither the insurance company nor the insured will do anything to jeopardize the right of the other party to receive the benefits of the agreement. Consideration must be given to the interest of the insured at the same valuation as the insurance company in order for the insurance company to successfully fulfill its obligation of good faith and fair dealings.

If an insurance company should deprive the insured of the benefits of the policy unreasonably or without just cause, this is a breach in the implied obligation of good faith and fair dealing. It is much more than simply failing to use due caution. The insured does not have to prove that the insurance company willfully intended not to honor the claim in order to hold the company liable.

If the insured feels their insurance company has deliberately placed roadblocks in the process or has unfairly refused to honor the claim, they can pursue the case in civil court and collect on a judgment there. The insurance company representative may believe his actions are in the right but lies, trickery, and unnecessary procrastination can negatively affect the bond of trust between insurer and client. The obligation of good faith is more involved: bad faith may be obvious and good faith may call for more than just honest dealing. Because it is impossible to catalogue all types of bad faith, here are a few types recognized in judicial decisions: evading the spirit of the bargain, not putting forth effort or slacking off, willful render of imperfect performance, abusing the power of specific terms, and interfering with or failure to cooperate in the other party's performance.

In order to make the law more clear, some examples of insurance company bad faith may be looked at. With automobile insurance policies, if an insurance company provides uninsured motorist coverage for their insured and their insured is involved in an accident with an uninsured driver, then the insured is guaranteed prompt and fair payment by the policy. Though they may eventually pay the claim, insurance companies may be liable for bad faith if they disputed the value of the insured's injury or withheld benefit payments. If a payment on a claim is unreasonably delayed, then the insurer could be committing bad faith.

Insurance bad faith also occurs when an insurance company denies a claim (whether for life insurance benefits, property damage, etc.) based on an irrational interpretation of the policy. This scenario will often occur when a policy is subject to interpretation because the definition of a condition or prerequisite to coverage is not specifically outlined by the policy. Then the insurance company is left to define or interpret the language of the policy on its own. The insurer could be liable for bad faith if they ignore the plain meaning of a word or neglect to give the appropriate weight to the insured's interpretation of the policy. Remember that any ambiguity in the way the policy is written benefits the insured rather than the insurer. The exclusions in an insurance policy must be reasonable and easily understood and not be wide-ranging in scope.

An insurance company is not obliged to pay every claim, although the law typically favors the insured party in cases of bad faith. The insurer has a duty to deal fairly with the insured as well as a duty to its other policyholders and to the stockholders to maintain adequate reserves through the non-payment of invalid claims. The practice of increasing insurance rates on the insurance seeking public could be a means by which the insurer is driven right out of business.

Once bad faith is proven, compensation includes damages and harm caused by non-payment and delays. It is up to the insured to prove the amount of their damages. The insured, however, is not required to prove the exact amount of damages that would be considered adequate compensation for the harm. Intangible elements like emotional pain and suffering can also be considered damages that require reimbursement. Attorney charges can also be redeemed by the insured. As was mentioned previously, the insured may be awarded punitive damages in appropriate cases.

No wonder most people feel uncomfortable and insecure during job interviews - - what if they don't buy what you're marketing or selling?

To increase your confidence in job interviews, it's important to make a direct, meaningful connection with the interviewer. Below I have provided 5 job interview tips that will help you minimize your anxiety and increase your confidence in the job interview.

1) Be aware of how you present yourself as soon as you walk in the door. The job interview begins as soon as you meet the front office staff (receptionists, secretaries, administrative assistants, etc.) Present a courteous and agreeable manner even if you had problems with finding the location, or if you're feeling nervous.

2) Recognize that the first impression is formed in the first few minutes of contact. This may seem unfair, however, this is still good information to know in advance. Your knowledge gives you power and a sense of control. The most important thing is to take a deep breath before you shake the interviewer's hand. Relax, look the interviewer squarely in the eye, and smile. Your muscle memory will now kick in and make a mental note that you're not in danger. The interviewer will be put at ease and your first impression will be professional and composed.

3) Check out your interviewer's surroundings so you can find helpful cues and signs. Even if the interviewer has brought you to a generic conference room for the interview, he or she will still provide cues or signs to help you connect. What is the interviewer wearing? If you're in the interviewer's office, what pictures are on the desk? What certificates are on the wall? Look around as you are seated so you can begin to make that human connection with this person. Your awareness of these physical cues will help you see that this interviewer is simply an individual who wants to share a conversation with you.

4) Stay a step ahead of the interviewer by analyzing their style. Every job interviewer will provide you with keys to succeeding within the interview. If you check out their voice and behavior you'll begin to see a pattern that emerges. They may pause before asking the tough questions - - or they may shoot them out quickly. They may keep the entire interview on a casual level - - or keep it very formal. Your role is to check out the patterns of their behavior and find a way to mirror what you see. You do not need to change your entire personality for an interview, but it is time to match the mood and tone. In this way, you begin to forge a connection.

5) Don't leave without asking some questions. I'd recommend taking mental notes of a few things that you hear during the interview so that you can bring up a related comment or question at the end. Yes, of course, you should have prepared a few questions to ask prior to arriving. But, be sure to double back to something the interviewer has said during the interview. In this way, you will be able to reinforce the connection which has been created.

Stop Leaking Leads: Lead Retention

Lead Retention is your system for staying in contact with the people whose contact information you have captured and that you stay in touch with until you decide to discard them or until they do business with you. This includes what we call 100% lead follow up.

The Need and the Reward

Most Agents lose a lot of leads. They lose them by not asking for names or numbers, not returning calls and e-mails, or calling once and not staying in touch. Lower producing Agents usually feel guilty about this. Higher producing Agents lose more leads than their lower producing counterparts and often don�t feel very badly about it because they do follow up on enough leads to reach very satisfying production and income levels.
We know these as facts. When we first start coaching an Agent, in a matter of days or weeks, they are having more appointments with buyers and sellers more consistently than ever in their career. This happens with far more than half of our clients. The reason for this rapid improvement is simply because of their focus, attention and effort to follow up on the leads already coming to them.
The facts are that the more business you do; the more leads you generate and the more challenging it is to respond and stay in touch with all of them. As you follow up on more leads in addition to increasing your business and your income you will find an increase in your confidence, your attitude and your professional self esteem. It feels good to know that you are wrapping up loose ends.

The Two Necessary Tools

Lead retention, 100% lead follow up requires two very simple tools.

1. An alphabetized record of the lead names, contact information and notes you make.

2. A note on your calendar or contact management software to prompt you on the day you
choose to call them.

Obviously, the ideal way to manage your leads is with contact management software that does it all for you. You create a record with the person�s personal and contact information. From their record you choose the next contact date and the software literally pops up their name on that date. You simply click on the name. It opens their file. You can even connect your computer directly to your phone so that their number is dialed with one more click of the mouse.
Most people don�t use contact management software in that way, even though they may wish to do so. One of our clients, the number one Agent in a multi-office company with over a thousand
Agents still used index cards and his calendar for lead retention up until a year ago.
When leads came to him, he or his assistant would employ both of the necessary tools above.
His alphabetized records were index cards. He prompted himself to make the lead follow up calls and his assistant prompted herself to make the calls by writing the person�s name on their calendars on the day they chose to make the next call.
I tell you this so that you clearly understand that 100% lead retention is not about the tools that you use. It is about recording, contacting, and staying in touch with enough leads to continuously exceed your exceptional goals. Face it if you don�t know how to use a tool you are simply not going to use it. Success Hours

In an earlier article on Lead Contact I shared with you the idea of Success Hours. This is the habit of scheduling an hour each day to call your leads. During this same time frame you make the calls and manage the leads with whatever system you use.
There is an easy way to schedule this. Everyone checks his or her e-mail early in the day. Opening your email first thing in the morning is a trap. Don�t do that! Instead open your contact management software or take out your box of index cards, and gather all the scraps of paper with your leads on them. Make the calls. Note the results. Prompt yourself on your calendar to make the follow up calls. Use your Success Hours to both make contact with your leads and to manage the system you have for retaining the leads.
If you use your Success Hour at least three times a week, you will take complete control over your lead contact and follow up. Your production will rise along with your confidence and self-esteem.
Some Agents just aren�t built to be that structured. If you want to continue to contact leads and follow up randomly throughout the day, no problem as long as the result is that each week you derive the number of appointments that you need to reach your exceptional goals. I would suggest that at some point if you are to reach one of your next levels you or an assistant will need to add greater structure to this effort.

How To Drywall Quickly And Easily?

Everyone who wants to own a house knows that it is not easy. With the rising costs of construction materials, everyone is looking for more affordable ways to build their own houses. Some don't hire contractors and just do it themselves. Others look for economical means that can save them time and money while achieving their desired dream home.

One of the most inexpensive and faster building method is through the use of drywalls. It involves the building of interior walls without the use of mortar. Anyone can do it, even those who are inexperienced in home construction. Drywalls can be installed quickly and easily. And here are some tips for all drywallers, both seasoned and new alike.

One of the most important things to do in order to drywall quickly and easily is to prepare. Inspect your workplace and determine the exact work to be done. Remember that drywalling is not only done for walls but also on ceilings. Gather all the tools and equipment that you will need. To be able to drywall quickly and easily, some of the more important tools you need are:

" t-squares, " sharp utility knife " tool belt " keyhole saw " pencil, pen or chalk " ladders and benches " drywall screws and nails " drywall drill " electric screwdriver " crowbars and hammers " sanding paper " mudding and taping knives " various joint compounds " sheetrocks or the boards

To drywall quickly and easily, you must be familiar with the measuring and cutting of the boards. Make sure that each board doesn't overlap with each other. Leave a small amount of space between each board as much as possible.

After you have measured and cut the boards, the next thing to do in order to drywall quickly and easily is to mount the boards on the wall supports. You can use a hammer or you can use an electric screwdriver. You can also look for wall studs. These can serve as your guide on the position of your boards.

Now that the wall is in place, you can now finish the joints. First off is to tape the various joints in order to hide the edges of the boards. Also make sure that you hide the nail and screw heads. These will make the wall look like one whole board. Afterwards cover it with a compound joint. Wait for these to dry before applying another coat. Again wait for these to dry and then apply a finishing coat. All in all, it should take at least three coats.

The last thing to do to drywall quickly and easily is to sand the walls. These will make the walls smooth and pleasant to touch. It will also make the wall ready for whatever design you want on it. Either you apply some paint or you put some wallpaper.

And you're done. All it really takes to drywall quickly and easily is a little bit of hard work, perspiration and the willingness to be injured sometimes by hammers and wood splinters. But then, it's just a small price to pay to be able to have that much coveted dream house.
